Please read these terms carefully before using our FSBO platform. By accessing our services, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using the FSBO platform, you confirm that you are at least 18 years old, have read and understood these Terms of Service, and agree to be bound by them. If you do not agree to these Terms, please do not use our services. Your continued use of the platform constitutes acceptance of any updates to these Terms.
2. Description of Services
FSBO provides an online marketplace where private sellers can list vehicles and where buyers can find and purchase those vehicles. We offer an advertising platform and do not assume any role as a licensed dealer, intervene in the buyer/seller relationship, or otherwise act as a party to any transaction between users.
3. Seller Responsibilities
As a seller, you agree to provide accurate, complete, and truthful descriptions, prices, and information about your vehicle. All listings must meet our listing requirements. You are solely responsible for the accuracy of your listing, the condition of the vehicle, and completing any legally required disclosures in your state or jurisdiction.
4. Buyer Responsibilities
As a buyer, you understand that FSBO is not a party to any sale. You agree to inspect vehicles thoroughly before purchase, conduct your own due diligence, and assume all risks associated with private vehicle purchases. All sales are conducted directly between the buyer and seller, and FSBO bears no liability for the outcome of any transaction.
5. Listing Fees and Payments
Creating a listing on FSBO is currently free of charge. FSBO reserves the right to introduce fees for premium features, enhanced listings, or additional services. Any applicable fees will be clearly disclosed before you are charged. Payments, where required, are processed securely through our third-party payment providers.
6. Prohibited Conduct
You agree not to post false, misleading, or fraudulent listings; use the platform for any fraudulent transactions; create multiple accounts to circumvent restrictions; interfere with platform operations; use automated bots or scripts to scrape or interact with the platform; or engage in any activity that violates applicable law or the rights of other users.
7. Limitation of Liability
FSBO is not a party to transactions and will not be liable for any loss or damage incurred as a result of the sale of a vehicle, the condition of vehicles, or as a consequence of any other action or inaction of a user. To the maximum extent permitted by law, our total aggregate liability to you is limited to the total fees paid by you to FSBO in the twelve months preceding the claim.
8. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. We will notify registered users about material changes via email at least 14 days before they take effect. Continued use of the FSBO platform after changes take effect constitutes your acceptance of the revised Terms.
